PREAMBLE

These general conditions of sale apply between:

The company HOME DECORATION (Commercial Name: MIS EN DEMEURE), SAS with capital of 1,970,200 euros, having its registered office at 27 rue du Recherches Midi – 75006 Paris – FRANCE, registered with the Paris RCS under number 453 615 767, NAF code 4759B, Intracommunity VAT number FR72453615767, editor of the site www.misendemeure.com

Hereafter : « MIS EN DEMEURE»

And :

Anyone making a purchase on the site www.misendemeure.com

Hereafter : “The CUSTOMER”

The CUSTOMER declares to have the capacity to conclude this contract, that is to say to have the legal majority and not to be under supervision.

I - ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE

MIS EN DEMEURE reserves the right to adapt or modify these General Conditions of Sale “GTC” at any time.

The version of the GTC applicable to any sale is the one appearing online on the site www.misendemeure.com at the time of the Order.

Consequently, the fact of placing an Order implies prior, irrevocable and unreserved acceptance by the Customer of these GTC.

II - DURATION

These GTCS apply throughout the duration of the online publication of the products and services offered by MIS EN DEMEURE.

III - REGISTRATIONS ON THE SITE

a) PARTICULAR CUSTOMERS

To be able to place an Order, the Particular customer must first register on the site by creating an account “the Account”.

After verifying the information, the Customer receives a registration confirmation email in return.

By registering on the Site, the Customer declares and guarantees to MIS EN DEMEURE that he is of legal age and has the legal capacity to contract.

MIS EN DEMEURE may delete the Client’s Account at any time, for any reason, at its sole discretion.

b) PROFESSIONAL CUSTOMERS

To be able to place an Order, the Professional customer must first register on the site by creating an account “the Account”.

After verifying the information, the Customer receives a registration confirmation email in return.

By “professional” we mean people who can justify an activity of Decorator, Architect, Reseller in the field of decoration or in hotel and restaurant business.  

Note that a minimum order of € 2 500 is required for any order made by a Professional customer through our website, sales department or showroom.

IV - PRODUCTS AND SERVICES

The products are understood by all the articles or services listed on the site www.misendemeure.com “the Products”.

The Products offered for sale are described and presented with the greatest possible accuracy. However, if errors or omissions may have occurred in this presentation, MIS EN DEMEURE cannot be held liable.

The photos representing our Products are only indicative. These photos, like the texts illustrating the products, do not enter into the contractual field.

V – ORDERS

The Customer can select as many Products as he wishes which will be added to his basket. The latter summarizes the Products chosen by the Customer as well as the prices and costs relating thereto. The Customer may freely modify the Basket before its validation as an Order. The validation of the Order constitutes confirmation of the acceptance by the Customer of the GTC, of the Products purchased, their price as well as the associated costs.

A confirmation email summarizing the Order will be sent to the Customer by MIS EN DEMEURE. To this end, the Customer formally accepts the use of electronic mail for the confirmation of the content of his Order. Invoices are available in the “my account” section of the Site.

VI – PRICES AND TERMS OF PAYMENT

The prices of the products and services presented on the Site are indicated in Euros, all taxes included (TTC). They are applicable during the validation of the order by the Customer and do not include the participation in transport costs, invoiced in addition and indicated on the “DELIVERY” page of the basket before the final validation of the order. Prices inclusive of all taxes are understood to include VAT (Value Added Tax) for products delivered in the European Union. Items subject to VAT are subject to French VAT. Any change in the legal rates of French VAT will be reflected in the price of the products and services presented on the Site, on the date stipulated by the relevant implementing decree.

In the event of obvious errors in the displayed price, MIS EN DEMEURE reserves the right to cancel the Order. Payments already made will be refunded immediately.

The prices of the Products offered on the Site are binding only on the Site itself, and in no case on the partner shops or showrooms which are free to offer the Products at a different price.

The lamps unless otherwise indicated on the product sheet are sold without lampshade.

VII – BILL

The invoice is sent to the e-mail address indicated when ordering and is also available in the “My Account” area of the site. It is established in accordance with the price list in force on the day the order is placed. MIS EN DEMEURE declines all responsibility for entry errors.

VIII – DELIVERY

The delivery times indicated on the Site are indicative, they cannot be respected in particular in the following cases:
• Exceptional peak in activity (sales period, etc.)
• Public holiday in France
• Failure to receive payment from the CLIENT on time
• Anti-fraud verification procedure on the CLIENT’s order

The shipments are then taken care of by a transport provider who ensures the transport to the delivery address indicated by the CUSTOMER.

Any order placed on the Site can only be sent to the destinations offered. For any request to send abroad, please contact us at contact@misendemeure.com.

The delivery times indicated on our site were communicated to us by the transport providers and are purely indicative. Exceeding these deadlines may in no case be held against MIS EN DEMEURE, nor give rise to a termination of the contract or to any compensation for damages.

The risks of transport are the responsibility of the CUSTOMER from the time of leaving the warehouse. The CUSTOMER must check the condition of the packaging and the conformity of the items delivered and immediately report any anomaly to MIS EN DEMEURE. Any reservations should be made on the delivery slip presented by the carrier and must be sent within 48 hours by e-mail to: contact@misendemeure.com

IX – REFUNDS, RETURNS AND RIGHT OF WITHDRAWAL

In the event of exercise of the right of withdrawal, MIS EN DEMEURE is required to reimburse the Customer for the sums he has paid, without penalty, with the exception of shipping costs.

Reimbursement of the Order is due without delay and at the latest within fourteen (14) days of the date of receipt of the returned products, on condition that the latter are in a state of resale. If the return of the product (s) purchased is due to an error on the part of MIS EN DEMEURE, the shipping and return costs will then be fully reimbursed to the Customer.

If one or more Products of the Order are not suitable, in accordance with article L.221-18 of the Consumer Code, the Customer has a period of 14 days from the date of receipt of his Order, to exercise the right of withdrawal of his order without having to justify his decision. The return or cancellation may concern all or part of the Order. The Customer is then required to return the Order, without undue delay and, at the latest, within fourteen (14) days following the communication of his decision to withdraw in accordance with article L. 221-21 of the Consumer Code. . The Product must be returned in its original packaging, in its original condition. After the period of fourteen (14) days, the sale will be considered firm and final.

X – WARRANTY AND EXCLUSION OF LIABILITY

MIS EN DEMEURE is liable for any lack of conformity of the Products under the conditions of Articles L.217-4 et seq. Of the Consumer Code and hidden defects in the item sold under the conditions provided for in Articles 1641 et seq. Of the Civil Code.

  • The legal guarantee of conformity

To act as a legal guarantee of conformity, the Customer has a period of two years to act from the delivery of the Product to act. The Customer is required to inform customer service of his wish to exercise his warranty rights as soon as he becomes aware of it, justifying his complaint accompanied by supporting documents (photos in particular). In the event of a proven defect, the Customer may request the exclusion of any other compensation or damages: either the replacement of the product, or the reimbursement of the product including transport costs.

The legal guarantee of conformity only applies to the essential characteristics of the products. As such, even if the photographs of the products presented on the Site are as faithful as possible, they cannot ensure a perfect similarity with the products offered, in particular with regard to the colors.

On the other hand, it should be noted that the Customer cannot contest the conformity by invoking a defect that he knew or could not ignore when he ordered.

  • The legal guarantee against hidden defects

The Customer may decide to implement the guarantee against hidden defects of the item sold within the meaning of article 1641 of the Civil Code. To benefit from this warranty, this requires both that the defect or defect is serious, hidden, that it existed at the time of purchase and that it is not due to improper use of the product.

If the defect or defect is proven, the Customer has 2 years from its discovery to act. The latter may request the exclusion of any other compensation or damages: either a reduction in the sale price, or the reimbursement of the product including transport costs.

Whatever warranty is requested, the procedure to be followed to return the Products will then be indicated to it by MIS EN DEMEURE.

XI – PROPERTY RESERVE

MIS EN DEMEURE retains ownership of the goods until full payment of the price by the buyer.

This right of claim relates to the goods as well as to their price if they have already been resold (under the law of 12 May 1980).

XII – APPLICABLE LAW AND COMPETENT JURISDICTION

The sale of products and services presented on the Site is subject to French law.

In the absence of an amicable resolution by exchange with our customer service, any dispute relating to the interpretation of the GTC, the execution or termination of a sale, the interpretation, execution or termination of these GTC is submitted to the courts.
